Hintertux Park Opening 2026 DISCLAIMER, VOLUNTARY ACCEPTANCE OF THE RISK AND WAIVER OF LIABILITY AGREEMENT

This DISCLAIMER, VOLUNTARY ACCEPTANCE OF THE RISK AND WAIVER
OF LIABILITY AGREEMENT (“Agreement”), is entered into by and between

Participant and Zillertaler Gletscherbahn GmbH & CO KG. As used in this Agreement, the term Participant shall include the parent or legal guardian if the Participant is under the age of eighteen (18).

WHEREAS, Participant has voluntarily agreed to enter in the Hintertux Park Opening being held at the Hintertux Glacier.

WHEREAS, Participant, recognizing that participation in any of the scheduled events is a HAZARDOUS ACTIVITY which is inherently dangerous, has voluntarily entered one or more of the events despite all known and unknown risk of serious personal injury and/or death presented by practicing for and actually participating in any of the events; and

WHEREAS, Participant understands that this Agreement is a general disclaimer prohibiting the Participant from bringing any claim for damage to property, personal injury and/or death related to practicing for or participating in any of the events; and

WHEREAS, Participant knows his/her own capabilities and limitations regarding each of the events entered; and

NOW, THEREFORE, in consideration of being permitted to participate in one or more of the events, Participant expressly and freely agrees as follows:

1. TO ACCEPT ALL RISKS of damage to property, serious personal injury and/or death arising from practicing for and/or participating in the various events.

2. To inspect the course closely prior to practicing for or participating in any of the events.

3. To WAIVE any and all claims that Participant may have against, Zillertaler Gletscherbahn GmbH & CO KG, for any and all loss, damage, injury or expense that Participant may suffer, or that Participant’s next of kin may suffer, as a result of Participant’s practicing for or participating in any of the events ZILLERTALER Gletscherbahn GmbH & CO KG.

4. To RELEASE FROM LIABILITY AND HOLD HARMLESS
Zillertaler Gletscherbahn GmbH & CO KG from any and all loss, damage, injury or expense that Participant may suffer, or that Participant’s next of kin may suffer, as a result of Participant’s practicing for or participating in any of the events, due to any cause whatsoever, except in cases of intentional or grossly negligent conduct by Zillertaler Gletscherbahn GmbH & CO KG..

5. That Austrian law is to be applied with regard to this Agreement.

It is agreed that the Austrian Courts shall have sole jurisdiction over any disputes arising from this Agreement; any reference to a foreign legal system or foreign law is excluded.

I hereby freely agree to allow Zillertaler Gletscherbahn GmbH & CO KG and its sponsors the right to use, in perpetuity, any and all likenesses or images of me taken during my participation in any event collateral and promotional materials.

I, the undersigned Participant having read and understood the terms of this Agreement, sign this Agreement freely and of my own accord, realizing that it is binding upon me, my Heirs, assigns and next of kin.

DISCLAIMER KIDS SHRED

Participation in the Kids Shred event is at your own risk; parents are liable for their children. Every participant is aware that this involves sports which carry risks to life and health. The organizers expressly point out that using features such as rails, boxes, and kickers is dangerous and requires mastery of the sport. It is impossible to completely safeguard these features with padding or similar measures.

Any liability of the Zillertaler Gletscherbahn GmbH & CO KG is excluded, except in cases of intentional or grossly negligent conduct by Zillertaler Gletscherbahn GmbH & CO KG. Furthermore, it is the sole responsibility of the parents of each participant to ensure adequate insurance coverage, particularly private liability and accident insurance.

I hereby agree that my son/daughter may participate in the Kids Shred event from October 3rd to 4th, 2026, at the Hintertux Glacier.

Please note that photos and/or videos may be taken at the event locations and may be published for the purpose of documenting the event. The legal basis for this is Article 6(1)(f) of the GDPR (legitimate interest) of Zillertaler Gletscherbahn GmbH & Co KG.

Terms and Conditions

All deliveries and services of hintertuxparkopening.com through the online shop shall be dealt with exclusively on the basis of the general terms and conditions at the time of the particular order. hintertuxparkopening.com acknowledges conflicting conditions only if we have expressly acknowledged them in writing.

Cancellations made 5 days or more in advance of the event date, will receive a 100% refund. Cancellations made within 2 - 5 days will incur a 50% fee. 

To exercise the right of cancellation, you must inform us (support@hintertuxparkopening.com) of your decision to withdraw from this contract by an unequivocal statement (e-mail). You may use the page Orders and Returns on cancellation, but it is not obligatory.

To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right of revocation before the cancellation period has expired.

PAYMENT OPTIONS

You can choose from different payment methods: Visa, Mastercard, Maestro and American Express. We reserve the right to reject certain payment methods. If you choose to pay in advance, you will receive our bank information together with the order confirmation. The money transfer is to be made to the indicated account within 7 days.
